PENN fined $15K over Rece Davis’ ‘Risk-Free’ remark

The Massachusetts Gaming Commission (MGC) fined PENN Sports Interactive $15,000 after ESPN host Rece Davis referred to a bet as a “risk-free investment” during a “College GameDay” segment in March 2024. PENN, which operates ESPN Bet, was penalised for violating advertising standards.

Rece Davis’s comment

In March 2024, during a “College GameDay” segment, Rece Davis and ESPN betting analyst Erin Dolan discussed NCAA men’s basketball picks for the UConn vs. Northwestern game. Davis referred to gambling as a “risk-free investment,” which was flagged as misleading under Massachusetts gaming advertisement laws.

The MGC flagged Rece Davis’s comment, calling a bet a “risk-free investment”, as misleading. The term “risk-free” violates state regulations that prohibit deceptive or false gambling promotions. The Massachusetts Gaming Commission ruled that the statement breached advertising standards and compromised responsible gambling messaging.

The adjudicatory hearing

After Davis’s comments aired, the MGC’s Investigations and Enforcement Bureau launched an inquiry to assess whether PENN Sports Interactive had violated compliance standards through its ESPN Bet content. The MGC held an adjudicatory hearing on the incident. Although PENN Sports self-reported the issue, the Commission found that neither PENN nor ESPN took adequate corrective action. PENN was found in violation of marketing compliance rules and fined $15,000.

ESPN Bet’s content guidance

ESPN Bet’s internal guidelines prohibit language that guarantees success or includes terms like “free” or “risk-free.” ESPN and PENN employees received compliance training in 2023. The MGC noted that Rece Davis attended a session on these rules, making his comment a clear violation of expected standards.

Following the incident, Rece Davis posted on X to clarify his comment, stating it was not intended to mislead. The MGC criticised the response for lacking seriousness and failing to acknowledge the compliance violation. The regulator considered it a missed opportunity to address the issue publicly.

The Pat McAfee show appearance

Rece Davis addressed the incident on The Pat McAfee Show, stating he was not apologising and referencing a well-known quote about wagering. The MGC viewed his remarks as dismissive and reiterated that the issue was the use of misleading language that could promote irresponsible gambling.

PENN’s responsibility and compliance issues

Even though Rece Davis worked for ESPN, the MGC held PENN Sports Interactive accountable as the authorised operator of ESPN Bet. Although PENN self-reported the occurrence, the Commission criticised the lack of a formal apology or public correction. The ruling emphasised the need for increased transparency in compliance matters and pointed out that there was no significant follow-up outside of internal talks.

The dispute draws attention to the hazy distinction between ESPN’s betting business and its sports broadcast. Because ESPN Bet is included in network programming, viewers could find it difficult to distinguish between promotional messaging and editorial comments.

PENN received a $25,000 fine in 2023 for utilising the deceptive phrase “Can’t Lose Parlay” in a Barstool Sportsbook promotion. Despite being lesser, the 2024 punishment demonstrated the MGC’s ongoing concern about PENN’s compliance and emphasised the significance of continual messaging about responsible gaming.

Broader implications for sports betting media

Media content is being constantly watched by regulators as sports betting grows in popularity. Phrases such as “risk-free” are against compliance regulations and could encourage careless gambling. In order to guarantee journalistic accuracy, networks and operators need to make sure their material complies with legal requirements. ESPN and PENN have improved internal monitoring and fortified compliance training for on-air employees in the wake of the fine.
